• Be solely responsible for the activity that occurs under your account and for the security of your password.

4. Terms of Sale

• Products: We sell smart rings, portable electronic devices designed to track health signals.

• Orders: We reserve the right to refuse or cancel any order for any reason.
• Delivery: Delivery dates are indicative only. We are not responsible for delays or losses caused by the carrier.

5. Smart Ring Use and Data

• Personal Data: Use of the smart ring requires the collection of personal and health data (e.g., heart rate, sleep cycles). This information is essential for the product's function and is stored in the Qing app. By using the ring, you consent to this collection.
• Security and Risks: Smart rings are connected devices that may present risks, including technological dependence, bugs, data loss, and risks of hacking or commercial data exploitation.
• Technological Dependence: The device is susceptible to crashing, malfunctioning, or desynchronizing with your phone.
• Non-Repairability: Connected rings may be impossible to repair in case of failure and become a disposable product once the battery dies.
• Health Disclaimer: The ring is a wellness and tracking tool. The data collected is not certified medical data and must never be used for medical diagnosis or to replace the advice of a healthcare professional.

6. Privacy Policy

The collection and use of your personal information are governed by our Privacy Policy, which is an integral part of these TOS. We strongly recommend that you read this policy. It details, among other things:

• The types of data collected by the ring (heart rate, sleep, etc.).

7. Limitation of Liability and Warranty

• General Limitation: To the fullest extent permitted by law, Biolink or any of its employees shall not be held liable for any issues arising from this site.
• Exclusions: We will not be held liable for issues arising from irregular use of the site, data loss, software or hardware bugs, decreased battery capacity, or security issues related to contactless payment.
• Warranty: The ring is covered by a limited 1-year warranty against manufacturing defects only. This warranty does not cover normal wear and tear, user-caused damage, or decreased battery capacity.

8. Indemnification

As a user, you hereby indemnify Biolink from all liability, costs, causes of action, damages, and expenses arising from your use of this site or your violation of any of the provisions set out herein.9. Applicable Laws and Jurisdiction

This document is governed by the applicable laws of Canada and the Province of Quebec and aims to comply with its rules and regulations. For residents of the EU, the GDPR is the applicable law governing this document.
